These Terms of Service ("Terms") govern any commission, purchase, or use of services from FoxianTech LLC ("FoxianTech," "we," "us"), a limited liability company registered in Montana, USA (File No. C1582383). By placing an order or making a payment, you ("client") agree to these Terms.
FoxianTech provides custom digital art services, including character design, illustrated art scenes, reference/turnaround sheets, and animation, as described on our Pricing page. Exact scope, style, and deliverables for each order are confirmed in writing (email or the platform used to place the order) before work begins.
Prices listed on this site are starting prices for standard scope. Final price for scenes, animation, and any request outside standard scope is confirmed as a fixed quote before payment is taken. Once a quote is accepted and paid, the price is locked for the agreed scope.
Orders proceed through: brief submission, fixed quote and timeline, payment, a draft/sketch stage for approval, and final delivery. We may pause work at any stage pending your response or approval.
Each package includes reasonable revisions during the draft/sketch approval stage. Requests that materially change the original brief (e.g. new characters, different style, added scope) after work has started are treated as a new quote.
Payment is processed through the payment method offered at checkout at the time of your order. Full payment (or an agreed milestone deposit for larger animation/scene work) is required before final files are released. Refunds are governed by our Refund Policy.
Delivered files are licensed to you under the terms set out in our License (EULA). Ownership of the underlying artistic technique and unused drafts remains with FoxianTech unless otherwise agreed in writing.
You are responsible for providing accurate references, requirements, and any content you ask us to depict. You confirm you have the right to request depiction of any characters, likenesses, or copyrighted material you provide as reference.
We do not accept commissions depicting minors in a sexualized manner, real identifiable private individuals without consent, hate symbolism, or content intended to harass or defame a specific person. We reserve the right to decline or cancel any order that violates this, with a refund handled per our Refund Policy.
FoxianTech's total liability for any claim relating to a commission is limited to the amount paid for that specific order. We are not liable for indirect, incidental, or consequential damages arising from use of delivered artwork.
These Terms are governed by the laws of the State of Montana, USA, without regard to conflict-of-law principles, to the extent permitted by applicable law.
We may update these Terms from time to time. Changes apply to orders placed after the update date shown above. Continued use of our services after changes take effect constitutes acceptance.
